State fee for civil matters

Upon determination of the size of state fees it is proceeded from whether the claim is proprietary or non-proprietary.

Upon filing a proprietary claim the plaintiff must, upon payment of the state fee, proceed from the value of the action arising from the rates of state fees set out in Annex 1 of the State Fees Act, unless otherwise provided by law.

Rates of state fees are as follows:

In certain events the State Fees Act provides for a specific amount of the state fee:

a state fee of 319,55 euros must be paid upon filing a statement of claim for divorce. If the claim for divorce includes a claim for division of property the state fee is calculated from the value of property;
a state fee of 319,55 euros must be paid upon filing a statement of claim to contest an industrial property right;
a state fee of 159,77 must be paid upon filing a statement of claim in a dispute concerning plant variety rights if the value of the claim cannot be determined;
a state fee must be paid in the following amount upon filing a petition or complaint concerning a bankruptcy proceeding:
9,58 euros for filing a bankruptcy petition by a debtor, or by a successor or administrator of the estate if the debtor is deceased;
383,46 euros for filing a bankruptcy petition by a creditor;
15,97 euros for filing any other petition or complaint concerning a bankruptcy proceeding.

§ 22 of the State Fees Act contains a list of judicial acts which are exempt from payment of state fees (in actions concerning wages or allowances or in actions for compensation for damage caused by bodily injury or in actions for proprietary damage caused by a criminal or administrative offence, etc.).

A court has the right to grant a person exemption from payment of state fees in whole or in part, based on the person's ability to pay. For that purpose the plaintiff must submit to the court a request and prove his or her inability to pay.

A state fee in the amount of up to 10 euros can be paid the court in cash when filing a statement of claim. If a state fee exceeds 10 euros, it must be paid by a bank transfer prior to filing a statement of claim with the court. The state fee must be paid to the bank account of the Ministry of Finance (No. 221023778606 in Swedbank or 10220034796011 in SEB Bank). The payment order must also indicate the reference number, which is different for each court; the reference numbers are indicated here.
