The land registry departments of county courts maintain a land register and a marital property register.
The land register is a register of real rights in immovable property. Immovables (registered immovables) comprise plots of land, apartment ownerships and rights of superficies and rights of superficies in apartments. Ownership relations and other real rights (mortgages, servitudes, notations concerning lease or prohibition, etc.) relating to the registered immovable are entered in the land register in respect of an immovable.
Land registry departments of the county courts also maintain the marital property register. If spouses have not chosen seperate property or the set-off of the property increment or it is not agreed differently with marital property contract, the property acquired by spouses during the marriage is as a rule the joint property of the spouses.
The Harju County Court, in addition to the land registry department and registration department, also maintains the succession register – data concerning wills, succession contracts, management of the state, succession proceedings and the succession certificate.
The register part of the land register, land register file and the data of the marital property register may be accessed electronically through the online inquiry system of the land register or the list of marital property register maintained by the Centre of Registers and Information Systems. Electronic register parts of the land register have legal effect.
