Ranking of an entry in the land register

All applications and documents submitted to the land registry department of the court by which an entry in the land register is requested to be made shall be promptly registered in the land registry journal. Entries regarding a registered immovable shall be made in the order the applications are registered in the land registry journal. This is very important because:

Firstly, the value of an encumbrance established on the registered immovable depends on the ranking. For example the value of each new mortgage shall be the value of the registered immovable less the value of previous mortgages.

Secondly, one application may prevent another entry from being made. For instance, if the request submitted for establishing a prohibition for the transfer of the registered immovable is registered in the land registry journal later than the application for transfer of the registered immovable, such prohibition does not prevent the transfer.
