How does the court review registration matters?

01. July 10
/

Registration matters are reviewed in land registry departments of county courts as written proceedings on petition. Maintaining a land register in the court guarantees that the entries made are legally correct and the decisions relating to the entries are impartial and independent. As a rule, registration orders are made by assistant judges, and not by judges. An assistant judge is an independent court official to whom only a judge can give instructions.

The assistant judge shall review the registration application within one month; an application to register a new immovable shall be reviewed within three months. As a result of the review an entry shall be made in the land register, a term shall be set for the elimination of omissions which prevent the entry from being made or the application shall be denied.

All persons concerned shall be notified within five workdays by post or by e-mail, if so requested, of the entry being made.
