Registration order

If an assistant judge holds upon review of a registration application that the legal prerequisites for making an entry in the land register are met, the assistant judge shall make an entry in the land register. In case of a legal impediment for making an entry, the assistant judge shall give in the registration order the reasons for which the registration application is denied.

If there are omissions in the registration application or if a required document is omitted, the judge or the assistant judge shall prepare a court ruling and set a term for the elimination of omissions.

An application regarding transfer of a registered immovable, encumbrance of an immovable or making a notation shall be reviewed within one month at the latest; first registration applications shall be reviewed within three months after receipt of the application.

Communication of registration orders

Within five workdays after making an entry in the land register the person who submitted the registration application, the owner of the registered immovable and all persons whose rights entered in the register the entry affects shall be notified thereof.

The person who submitted a registration application shall be notified of a court ruling by which a term is set for the elimination of omissions or the order regarding denial of the application.

Contestation of registration orders

If a person who submitted the registration application or a person whose rights the entry in the land register affects does not agree with the order or ruling made by the assistant judge, he may file an objection to the order of the assistant judge within 15 days after receipt of a copy of the order. The circuit court shall review the appeal pursuant to general appeal proceedings.

For the purpose of securing the rights of the person who appealed a notation concerning the prohibition of the disposal of the right concerning which the appeal is filed shall be entered in the land register. The land registry department ex officio deletes the notation concerning a prohibition when the appeal is withdrawn or rejected.
